Benelux
Benelux is our home jurisdiction. Although the number of national applications by non Benelux trademark proprietors has dwindled due to the introduction of the Community trademark and Madrid Protocol, Landmark can still be your address for service for:
- Trademark availability searches:
Prior to 1996 it was fairly easy to register a trademark in Benelux and because it is comparatively cheap, there are many registered trademarks covering the Benelux countries. This implies that there are many potentially conflicting marks on the Benelux Register. It therefore makes sense to find out whether your proposed mark is available in order to avoid any later problems.

- Conversion of a CTM into a national Benelux application:
Has your CTM floundered due to a successful opposition? Landmark will convert your CTM application into a Benelux application inexpensively.
- Use verification searches:
It may well be that an availability search reveals a potential bar to your proposed mark, which is older than 5 years and should therefore have been used. By way of a fast and thorough 'trademark in use search' we can verify whether the potential obstacle is really a threat to your proposed mark.
- Dealing with oppositions and conflicts:
On 1st January 2004, finally, an opposition system was introduced into Benelux Trademark law. The attorneys of Landmark are competent in filing such oppositions against fresh applications, which are confusingly similar to your or your client's marks.
